першій половині 1943 р.; максимальне посилення переслідування у 1943–1944 рр.;
The purpose of the article is to provide a comprehensive analysis of the Soviet practice of criminal prosecution of former members of the local police of the Reichskommissariat “Ukraine” during 1943–1959. The study focuses on the legal and regulatory foundations of criminal prosecution, the role of state security agencies and military justice institutions, the specific features of investigative and judicial procedures, and the transformation of criminal punishment practices during the wartime and post-war periods. The research seeks to determine how changes in Soviet legislation, institutional transformations of security agencies, and changes in state punitive policy affected the prosecution and punishment of former local police officers. The methodological basis of the study combines historical-legal, problem-chronological and comparative approaches. These approaches make it possible to examine criminal prosecution not as a homogeneous phenomenon but as a changing institutional and legal process. The source base includes Soviet normative and legal acts, provisions of the Criminal Code of the Ukrainian SSR, special wartime and post-war regulations, archival and investigative case files, and materials concerning judicial practice. Particular attention is paid to the relationship between the formal legal grounds for criminal responsibility and their practical implementation by state security agencies, military counterintelligence and military courts. The study analyses the legal framework used to prosecute former members of local police formations and examines the application of the relevant provisions of the Criminal Code of the Ukrainian SSR. It is established that service in the local police was not defined in Soviet criminal legislation as an independent criminal offence. In practice, however, the fact of service was frequently used as evidence of a “transition to the side of the enemy” and served as a basis for prosecution, primarily under Article 54-1(a) of the Criminal Code of the Ukrainian SSR. In cases involving former Soviet servicemen, Article 54-1(b) could be applied, while other provisions concerning counterrevolutionary crimes were used where additional circumstances were established. The study demonstrates that the legal qualification of the accused persons could differ substantially depending on the evidence concerning their individual participation in crimes, their previous status, and the political and institutional context in which the investigation was conducted. The research establishes the role of the NKVD–MVD, NKGB–MGB, military counterintelligence, SMERSH and military judicial institutions in identifying, searching for, arresting, investigating and prosecuting former police officers. The analysis shows that military tribunals and military field courts occupied a particularly important position during the wartime and early post-war periods. Their procedures were characterized by shortened investigation periods, restrictions on ordinary mechanisms of appeal and, in many cases, rapid execution of sentences. The study also examines changes in the system of punishment, including the abolition of the death penalty in 1947, its restoration for certain categories of crimes in 1950, and subsequent changes in judicial practice during the second half of the 1950s. A five-stage periodization of the Soviet prosecution of former local police officers is proposed. The first stage, covering 1941 to the first half of 1943, was characterized by the formation of a punitive mechanism in which extrajudicial violence coexisted with the development of a formal regulatory framework. The second stage, from April 1943 to 1944, was marked by the maximum intensification of criminal prosecution, the introduction of military field courts and the extensive use of simplified wartime judicial procedures. The third stage, covering 1944–1953, involved the institutionalization and systematization of prosecution through the regular activities of state security agencies and military justice. The fourth stage, from 1953 to 1956, was characterized by the correction of punitive practices, the review of earlier sentences and partial liberalization. The fifth stage, from 1956 to 1959, involved the dismantling of the extraordinary model of military justice and the gradual transfer of cases concerning civilians to courts of general jurisdiction. The analysis of individual criminal cases demonstrates the contradictory nature of Soviet prosecution practices. On the one hand, some accused persons were prosecuted on the basis of evidence concerning their direct participation in killings, arrests, beatings, escorting prisoners, persecution of civilians and other repressive activities carried out by the occupation authorities. Consequently, the prosecution of former police officers cannot be interpreted solely as an arbitrary repressive practice. On the other hand, the investigative procedures could involve physical and psychological pressure, attempts to obtain confessions, standardized formulations of charges, excessive reliance on witness testimony, restrictions on defence opportunities and the attribution of collective responsibility for the activities of police units to individual officers. The research therefore reveals a significant discrepancy between the actual degree of individual involvement in crimes and the legal assessment of such involvement. The theoretical significance of the study consists in refining the understanding of the functioning of the Soviet system of criminal prosecution of persons accused of collaboration with the German occupation authorities. The research demonstrates the importance of examining the interaction between legal norms, institutional structures, investigative practices and political changes rather than treating Soviet prosecution as a uniform phenomenon. The proposed periodization provides an analytical framework for distinguishing wartime emergency justice, institutionalized post-war prosecution, subsequent revision of sentences and the gradual restoration of ordinary judicial procedures. The practical significance of the research lies in the possibility of using its findings in further studies of Soviet justice, political repression, collaboration, military tribunals and the activities of Soviet state security agencies in Ukraine. The results may also be used in university courses dealing with the history of Ukraine, legal history, the history of state institutions, political repression and the transformation of judicial systems during wartime and post-war periods. The originality and scientific novelty of the study consist in combining three analytical dimensions: the examination of the normative and legal framework, the reconstruction of the institutional mechanism of prosecution, and the analysis of individual archival and investigative cases. The study proposes a five-stage periodization of the prosecution of former local police officers of the Reichskommissariat “Ukraine” and demonstrates how the relationship between formal legal norms and practical investigative and judicial procedures changed over time. It is established that the Soviet practice combined legally grounded prosecution of persons for whom evidence of participation in crimes against civilians existed with mechanisms that could violate principles of legality and individual responsibility. The study is limited by its focus on former members of the local police of the Reichskommissariat “Ukraine” and by the chronological framework of 1943–1959. Further research may expand the source base, compare the prosecution of different categories of persons accused of collaboration with the occupation authorities, and examine regional differences in investigative and judicial practices. Particular attention may also be devoted to the subsequent review of criminal cases, amnesties and the changing legal assessment of wartime collaboration in the later Soviet period.
